What is Dissolution of Marriage?

Dissolution of marriage is the fastest and most straightforward way to terminate a marriage in Ohio (§ 3105.61).  The dissolution process must be completed within 30-90 days from the day the case is filed in court and one of the spouses must have resided in Ohio for at least 6 months before filing (§ 3105.62).

Dissolution vs. Divorce

Ohio offers two ways to end a marriage: divorce or dissolution. In a divorce, fault is usually assigned to one spouse. For no-fault ground separations, dissolution is the simpler option.

Dissolution of marriage can be less expensive than divorce, as they avoid the drawn-out court procedures divorce requires.

For dissolution to work, both spouses must agree on issues like division of assets, property settlement, debt division, child custody, and other items that are divided when a marriage ends.

Dissolution is Possible When…

  • You and your spouse agree on every issue pertaining to your marriage.
  • You both sign all dissolution papers filed in court.
  • You both attend the hearing in the case.
  • There are no children born to the wife during the marriage that are not the husbands.

Simplify Your Separation

Get the peace of mind you deserve with a dissolution process that puts you in control with Cooke Demers Attorneys at Law, LLC.

What to Expect When Meeting with a Dissolution Lawyer

Unlike divorce, a petition for dissolution requires that both parties agree on all terms. This first meeting will set up the path forward to resolve the separation quickly and amicably.

Discuss your goals.

In your first meeting, you will discuss your goals for the division of property, child support and child custody agreements, parenting plans, and other issues about your marriage.

Review financial documents.

Bring any financial records—bank statements, tax returns, and property information. Your attorney will get a clear picture of your financial situation to help you reach a fair agreement.

Create the path forward.

Since dissolution skips court battles, your lawyer will outline a straightforward path to legal separation and will explain additional steps, including timelines and the necessary paperwork to petition for dissolution and to make sure the process is smooth and simple.
